1. OUR SERVICES

National Vaults (“Company,” “we,” “us,” or “our”) offers secure private storage solutions accessible via the website at www.nationalvaults.com (“Site”). Our services include the rental and sale of safes, vaults, safe deposit boxes, and custodial and depository storage options. We also provide a secure payment facility through third-party processors such as Stripe, which users may access via payment buttons on the Site.

By accessing or using our Site or services, you agree to be bound by these Terms of Use (“Terms”) and all applicable laws and regulations. You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. Use by persons under 18 is strictly prohibited.

2. INTELLECTUAL PROPERTY RIGHTS

All content and materials on the Site, including but not limited to text, graphics, logos, images, audio, video, software, and the Site’s design and layout, are the exclusive property of National Vaults or its licensors and are protected by U.S. and international intellectual property laws.

You may access and use the Site content only for your personal, non-commercial use. No right, title, or interest in any content is transferred to you. You agree not to reproduce, modify, distribute, republish, upload, post, transmit, create derivative works from, or otherwise exploit any content from the Site without our prior written consent.

If you believe any content infringes your intellectual property rights, please notify us immediately at legal@nationalvaults.com with the relevant details so we may address the issue promptly.

3. PROHIBITED ACTIVITIES

Your use of the Site is subject to compliance with all applicable laws and these Terms. You agree not to:

  • Use the Site for any unlawful purpose or activity;

  • Attempt to gain unauthorized access to any part of the Site, accounts, computer systems, or networks connected to the Site;

  • Introduce viruses, malware, spyware, or other harmful code;

  • Use automated systems or software (e.g., bots, scrapers) to extract data or content from the Site without permission;

  • Falsify your identity or information provided to us;

  • Submit fraudulent or unauthorized payments or financial information;

  • Interfere with the operation or security of the Site or attempt to disrupt any user’s use of the Site;

  • Violate the intellectual property rights or privacy rights of others;

  • Use the Site to harass, threaten, or harm others;

  • Attempt to reverse engineer or otherwise tamper with the Site’s underlying software or systems.

Violations of these prohibitions may result in suspension or permanent termination of your access to the Site and may subject you to legal action, including criminal prosecution where applicable.

4. USER-SUBMITTED MATERIALS

While the Site does not currently permit user-generated content such as comments or uploads, you may voluntarily submit information via our contact form or email. Such submissions are considered non-confidential and become the property of National Vaults.

By submitting information, you grant us the right to use, reproduce, modify, and distribute your submission as necessary to respond to inquiries or operate our business. You warrant that your submissions do not contain false, misleading, unlawful, or infringing material.

5. SITE OPERATION AND MANAGEMENT

We reserve the right to manage, modify, restrict, or discontinue any aspect of the Site or our services at any time without prior notice. This includes implementing security measures, limiting access, removing content, or ceasing service offerings.

We are not liable for any interruption or unavailability of the Site due to maintenance, technical issues, or third-party service failures beyond our reasonable control.

6. TERM AND TERMINATION

These Terms remain in effect as long as you access or use the Site. We may suspend or terminate your access immediately if you violate these Terms or applicable laws.

You may terminate your use at any time by ceasing all use of the Site. Provisions that by their nature should survive termination — including indemnity, intellectual property rights, disclaimers, and limitations of liability — will remain effective.

7. MODIFICATIONS AND INTERRUPTIONS

We may update or revise the Site and Terms at any time without prior notice. Your continued use after changes constitutes acceptance of the new Terms.

The Site may experience temporary interruptions or downtime for maintenance or unforeseen causes, for which we disclaim liability.

8. GOVERNING LAW

These Terms and any disputes arising hereunder are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.

You consent to the exclusive jurisdiction and venue of the state and federal courts located in Fairfax County, Virginia, for all disputes arising from or relating to these Terms or your use of the Site.

9. DISPUTE RESOLUTION

Informal Negotiations: You agree to attempt to resolve any dispute or claim arising from these Terms or your use of the Site informally by contacting us at legal@nationalvaults.com. We will engage in good faith efforts to resolve the issue within 30 days.

Formal Legal Proceedings: If unresolved informally, either party may pursue legal remedies exclusively in the courts of Virginia located in Fairfax County. You agree to waive any jurisdictional or venue objections.

Arbitration: Except where otherwise agreed in writing, no arbitration or class action waiver applies.

Waiver of Jury Trial: To the extent permitted by law, both parties waive the right to a jury trial for any disputes.

10. SITE ERRORS AND CORRECTIONS

We endeavor to provide accurate and current information on the Site, but errors and omissions may occur, including in pricing, product descriptions, or availability. We reserve the right to correct any mistakes without liability and to update information at any time without prior notice.

11. WARRANTY DISCLAIMER

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED USE.

We do not warrant that the Site will be error-free, secure, or free from viruses or other harmful components, nor that the services will meet your expectations.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NATIONAL VAULTS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SITE OR SERVICES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS;

  • INTERRUPTION OR LOSS OF BUSINESS OPPORTUNITY;

  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA;

  • ANY OTHER CONSEQUENTIAL DAMAGES.

EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO NATIONAL VAULTS FOR SERVICES IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR LIABILITY, SO SOME LIMITATIONS MAY NOT APPLY TO YOU.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless National Vaults and its affiliates, officers, directors, employees, and agents from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use or misuse of the Site or services;

  • Your breach of these Terms;

  • Your violation of any third-party rights or applicable law;

  • Any claim that your content or actions caused harm to another party.

14. PERSONAL DATA AND PAYMENT INFORMATION

We do not require user accounts, but when you submit payments via Stripe or contact us, we collect limited personal information such as your name, email, and payment details. We do not sell or share this information with third parties outside of those necessary to provide services (such as Stripe).

15. ELECTRONIC COMMUNICATIONS AND CONSENT

By using our Site and services, you consent to receive electronic communications, including emails and notices, from National Vaults. You agree that electronic signatures and records satisfy all legal requirements for written agreements under laws such as the Electronic Signatures in Global and National Commerce Act (E-SIGN Act).

16. GENERAL PROVISIONS

These Terms constitute the entire agreement between you and National Vaults regarding your use of the Site and supersede any prior agreements.

If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.

Our failure to enforce any provision shall not constitute a waiver of that provision or any other rights.

You may not assign or transfer your rights or obligations under these Terms without prior written consent from National Vaults.
